International Supply Contracts and Force Majeure

16 May 2019

Time: 6:00 - 8:00pm
Venue: Room 3.1, CCLS, 69 Lincoln's Inn Fields, London, WC2A

The QMUL-UNIDROIT Institute of Transnational Commercial Law is pleased to annouce the latest event in its new lecture series: International Supply Contracts and Force Majeure. The talk will be given by Michael Bridge QC (Hon), Emeritus Professor of Law at the London School of Economics and Professor of Law at the National University of Singapore.

One of the most intractable problems presented in international supply contracts, an expression used to signify charterparty and sale contracts, is posed by the need to reconcile the strict obligation of the supplier with the general law of frustration together with force majeure and related clauses. The complexity of the problem is aggravated by the need to reach further back to the contractual source of the goods that the supplier is bound to provide. A recent decision that has brought a keen light to bear on this problem – Classic Maritime Inc v Limbungan Makmur Sdn Bhd – will be dealt with at some length, not least because of the damages issue that it has identified.
