11:00 – 11:30: English Jurisdiction Clauses in Ship Finance and Security

This session will focus on whether an English jurisdiction agreement in a ship finance contract and the security for a loan agreement can be enforced. Recent case law such as the Supreme Court decision in Aspen Underwriting Ltd v Credit Europe Bank NV [2020] UKSC 11; [2020] 2 WLR 919 will be considered.

11:45 – 12:15 Innovation in Ship Finance: overcoming the challenges

This presentation will discuss legal issues arising from recent developments in ship finance including the adoption of the Poseidon Principles which introduced voluntary Environmental, Social and Governance (ESG) reporting requirements for financiers and alternative (non-traditional) sources of ship finance such as investment funds. The ship finance market's response to the challenges raised by COVID-19 and consequent restrictions will also be explored.

Biographies of the speakers

Yvonne Baatz is a Professor at the Centre for Commercial Law Studies, Queen Mary University of London. She is the editor of Maritime Law, the fifth edition of which will be published this summer and has published widely on Conflict of Laws, Carriage of goods, Charterparties and Marine Insurance.

Panagiotis Vavougyios is an associate within the finance group of Stephenson Harwood, focusing on asset finance and specialising in shipping finance. He is currently on secondment at the legal team of a French bank. Panagiotis holds an LLM in Commercial and Corporate Law and an LLM in International Shipping Law both with Queen Mary University of London.

Miriam Goldby is Reader in Shipping, Insurance and Commercial Law at the Centre for Commercial Law Studies, Queen Mary University of London, and director of the Centre’s Insurance, Shipping and Aviation Law Institute and its LLM Programme in International Shipping Law. She is a member of the CMI Standing Committee on Carriage of Goods and vice chair of ICC UK’s Commercial Law and Practice Committee. She is the author of Electronic Documents in Maritime Trade: Law and Practice (2nd edn, OUP 2019) and the editor of The Role of Arbitration in Shipping Law (OUP, 2016) and of Systemic Risk and the Future of Insurance Regulation (Informa, 2015). She is also the general editor of the British Insurance Law Association (BILA) Journal and a member of the BILA Committee.
