The UNIDROIT Principles on Digital Assets and Private Law

The UNIDROIT Principles on Digital Assets and Private Law were adopted by the UNIDROIT Governing Council in May 2023. The Principles contain recommendations to national legislators on how to deal with the private law issues raised by digital assets, such as cryptocurrencies or tokens.

The Principles and their benefits were introduced by Prof. Louise Gullifer, Rouse Ball Professor of English Law at the University of Cambridge, with a presentation on 'The benefits of the UNIDROIT Principles on Digital Assets and Private Law for the global markets in digital assets'. Prof. Gullifer explained why the approach taken by the Principles is the most useful in a global context, focusing, by way of illustration, on three main points covered by the Principles which have proved or are likely to prove to be important in the development of successful markets.

The Roundtable was chaired by Prof. Ignacio Tirado, Secretary-General of UNIDROIT, and our discussant was Simon Gleeson, consultant to Clifford Chance.
