Professor Jonathan Griffiths co-authors paper on Copyright in the Digital Single Market

This paper addresses a few selected aspects of the implementation of the new mandatory exceptions provided under Articles 3 to 7 of the Directive on Copyright and Related Rights in the Digital Single Market (Directive (EU) 2019/790).

The paper argues that, while the introduction of the exceptions and limitations established under Articles 3-6 represents an important step in the right direction, it remains a modest one. Member States will play a fundamental role in ensuring that the mandatory minimum level of freedom for users under these new exceptions and limitations becomes a reality and should refrain from imposing specific restrictive conditions at national level.

Under the auspices of the European Copyright Society, The paper was co-authored by Professor Jonathan Griffiths, Head of the Department of Law at Queen Mary University of London, with Professor Tatiana Synodinou, University of Cyprus, and Professor Raquel Xalabarder Plantada, Universitat Oberta de Catalunya. It was published in GRUR International, a monthly, peer-reviewed journal dealing scientifically with the fields of IP and Competition Law as well as the areas related to them.
