The Annual Lecture in Dispute Resolution 2017 will be given by Giuseppe De Palo, International Professor of ADR Law and Practice at Mitchell Hamline School of Law, on the subject “Mediation — Our Sleeping Beauty and the (Seeming) Dualism of Prince Charming”.
Despite global, intense and expensive efforts, the number of mediations conducted every year remains disappointingly low in most countries. Many believe our Sleeping Beauty will not wake chiefly because of a lack of quality and awareness, and thus seek a Prince Charming who will awaken mediation by fixing a perceived mismatch between what commercial users want and what providers offer. Others argue that quality and awareness are not enough to increase mediation use significantly; hence, they seek Prince Charming in legislation requiring serious and balanced mediation efforts before litigation. But mediation data analysis in a country where Sleeping Beauty did wake up a few years ago unveils the picture of the true Prince Charming. That prince is legitimate, according to the most recent jurisprudence of the European Court of Justice, and there to stay.
Giuseppe De Palo, International Professor of ADR Law and Practice at Mitchell Hamline School of Law, has been teaching courses in Negotiation and Mediation for over twenty years. In 1998, he invented and co-founded ADR Center, now one of the largest private mediation firms in Europe, managing in excess of 4,500 cases annually. Giuseppe was President of the Board of ADR Center until 2015, when he became Ombudsman for an international organization. Before joining international public service, Giuseppe was in charge of large international consulting projects - funded by the World Bank, the European Commission, the Inter-American Development Bank and other donors - to promote the use of ADR. He also advised the Ministers of Economy and of Justice of several EU Member States on mediation, and was called frequently to present his research before the European Parliament and national legislative assemblies. Giuseppe has mediated close to 1,500 cases in more than 60 countries, and continues to teach ADR subjects throughout the world.
