Module Description
This module concerns the legal mechanisms for protecting human rights at the Council of Europe level, primarily the European Convention on Human Rights, and questions of reform. Detailed study will be made of: the right to life (Art.2); freedom from torture and inhuman or degrading treatment (Art.3); the right to respect for private life (Art.8); freedom of religion (Art.9); and freedom of expression (Art.10). Problem questions will be solved utilising Convention case law and critiques made of current jurisprudence.
Module Aims
The aims of this module are as follows:
- To introduce students to the European Convention on Human Rights, a key aspect of the system of human rights protection established by the Council of Europe level.
- To equip students with knowledge of the major features of this system of human rights protection.
- To enable students to critically question the effectiveness of this system for the protection of human rights.
- To equip students with a knowledge of substantive human rights jurisprudence concerning the right to life (Art.2 ECHR), freedom from torture (Art.3 ECHR), respect for private life (Art.8 ECHR), freedom of religion (Art.9 ECHR) and freedom of expression (Art.10 ECHR).
- To enable students to apply substantive human rights law to hypothetical fact situations and formulate answers.
- To enable students to critically question international systems for human rights protection as compared to domestic systems.
