Your Proof or Mine? International Arbitration Advocacy and Tribunal in Action

The School of International Arbitration at Queen Mary University of London and Berwin Leighton Paisner LLP are co-hosting an International Arbitration Conference on Advocacy & Tribunal in Action.

The conference will provide a unique opportunity to witness both advocacy and a tribunal in action in the context of an application to an ICSID Ad Hoc Committee, concluding with the chance for delegates to cast their votes and express their views on the issues discussed.  

The issue under debate is: If a party fails to adduce reliable evidence on quantum, should the tribunal quantify damages itself or should it find that the claimant has failed to discharge the burden of proof?

    The Tribunal will deliberate in public, giving a unique insight into how arbitral tribunals operate and reach their decisions

Participant biographies

Ad Hoc Committee

  • Professor Dr Loukas Mistelis
    Professor Loukas Mistelis is Professor of Transnational Commercial Law and Arbitration at Queen Mary University of London.  He is an acknowledged authority on international dispute resolution. He has been listed as one of the “leading lights in international arbitration”, 45 under 45, amongst the top 15 highlighted members of the list and is also listed on the Who’s Who Commercial Arbitration since 2007. His substantial arbitration experience covers ICC, ICSID, LCIA, UNCITRAL, SCC, Swiss Chambers and Moscow cases.
  • Sir Peter Cresswell
    Sir Peter is a retired Commercial Court  judge currently practising as an independent arbitrator and mediator from 3 Verulam Buildings. He was called to the Bar in 1966 and took silk in 1983. He was Chairman of the General Council of the Bar of England and Wales in 1990.
  • Sophie Nappert
    Sophie is a dual-qualified lawyer in Canada and in the UK. She is an arbitrator in independent practice, based in London. Before becoming a full-time arbitrator, she was Head of International Arbitration at a global law firm.
    Sophie is trained and has practised in both civil law and common law jurisdictions. She is ranked in Global Arbitration Review's Top 30 List of Female Arbitrators Worldwide and is listed in the International Who's Who of Commercial Arbitration. She is described in the legal directories as 'a first-rate lawyer and one of the top new-generation arbitrators'. She is the peer-nominated Moderator of OGEMID, the online discussion forum on current issues of international investment law and arbitration.
    Advocates
  • Dr Roman Khodykin
    Dr Roman Khodykin is a partner in the International Arbitration Group of Berwin Leighton Paisner LLP.  He is a dual qualified solicitor of the Senior Courts of England and Wales and a Russian advocate and holds a PhD in Conflict of Laws.  Roman is an arbitration specialist with extensive experience in national and cross-border matters, with particular emphasis on corporate and shareholder disputes.  He is also an alternate member of the ICC International Court of Arbitration.   In recent years Roman has advised on a multi-million dollar ICSID investment treaty arbitration against a former Soviet Republic, and acted in LCIA, ICC, AAA and MKAS arbitrations. Roman has also represented athletes before the Ad Hoc Division of the Court of Arbitration for Sport. He also regularly writes on the subject of arbitration and has authored or edited several books, including “Arbitration Law of Russia: Practice and Procedure” (Juris, 2013).
  • Vasanti Selvaratnam QC  
    Vasanti Selvaratnam QC  is Joint Head of Stone Chambers London and Singapore. Vasanti is recommended in Chambers and Partners and the Legal 500 as a leading silk in international arbitration, where she is described as ‘An absolute pleasure to work with; she is thorough, articulate and easily gets into the detail.’ She is widely commended for her user friendly approach, attention to detail, responsiveness, and  cross-examination skills, particularly in technical cases. Vasanti regularly sits as Arbitrator and acts as Counsel in commercial disputes under the Rules of all major arbitral institutions.
  • Karen Maxwell
    Karen Maxwell practises in international arbitration, shipping, sale of goods, international trade, banking, private international law and insurance. After being called to the Bar, Karen practised at 20 Essex Street where she developed a commercial law practice, appearing before the High Court, Court of Appeal, House of Lords and in various arbitral proceedings including LMAA, LCIA, UNCITRAL and ICC. Karen also spent time at Practical Law Company establishing and leading Practical Law Arbitration before returning to the Bar. She wrote and developed guidance and current awareness covering all legal and practical aspects of English and international arbitration, including both commercial and investment treaty arbitration. Karen is also a co-author of London Maritime Arbitration, published by Informa and now in its third edition, and contributed the Arbitration Review section of the LMCLQ International Maritime and Commercial Law Yearbook 2010-13.
